Terms of Service

By accessing or using the Service you confirm that you have read, understood and agree to be bound by these Terms and by our Privacy Policy and Cookie Policy, which are incorporated by reference.

You must be at least 18 years old and capable of forming a binding contract to use the Service. By using the Service you represent that you meet these requirements.

Stay Optimiser analyses short-term rental listings (such as Airbnb listings) and generates reports containing analysis, comparisons and suggested improvements intended to help hosts present their listings more effectively. The Service is provided for informational purposes to assist your own decision-making.

Stay Optimiser is an independent service. We are not affiliated with, endorsed by, sponsored by, or otherwise connected to Airbnb, Inc., Booking.com, VRBO, or any other listing platform.All trademarks, service marks and trade names (including “Airbnb”) are the property of their respective owners and are used only for identification and descriptive purposes. Your use of any third-party platform remains subject to that platform’s own terms.

You are responsible for maintaining the confidentiality of your account credentials and for all activity that occurs under your account. You agree to provide accurate information and to notify us promptly of any unauthorised use. You may only submit listing URLs and content that you own or are authorised to submit.

You agree not to:

• use the Service for any unlawful purpose or in breach of any third-party platform’s terms;
• submit content that is unlawful, infringing, or that you have no right to submit;
• attempt to disrupt, reverse engineer, scrape, overload, or gain unauthorised access to the Service;
• resell, redistribute or commercially exploit reports without our written permission.

The Service is offered on a per-analysis basis and via prepaid credit bundles. Prices are shown at the point of purchase and are processed securely by Stripe. By purchasing, you authorise us (via Stripe) to charge your chosen payment method. Credits added to your account do not expire.

Because reports are generated and delivered to you on demand as a digital service, all sales are final and payments are non-refundable, except where required by law. If a technical fault on our side prevents delivery of a report you have paid for, contact us at hello@stayoptimiser.com and we will re-run the analysis or issue a credit.

Access to a generated report expires after 7 days for basic analyses and 30 days for premium analyses, measured from completion. After expiry you may no longer be able to view the report. Credits remain available subject to section 7.

The Service, including its software, design, text and branding, is owned by us and protected by intellectual property laws. We grant you a limited, non-exclusive, non-transferable licence to use the Service and the reports we generate for your own internal, non-commercial use. You retain ownership of the listing content you submit, and you grant us a licence to process it as needed to provide the Service.

Our reports are generated using automated analysis and artificial intelligence and are provided for general informational purposes only. We do not guarantee any specific outcome — including any increase in bookings, revenue, occupancy, ranking or reviews. Any figures, ranges or examples are illustrative and not a promise of results. The Service does not constitute legal, tax, financial, insurance or other professional advice. You are responsible for verifying information and for your own business decisions, and should seek qualified professional advice where appropriate (for example on licensing, tax or insurance).

The Service is provided “as is” and “as available” without warranties of any kind, whether express or implied, including implied warranties of merchantability, fitness for a particular purpose, accuracy, or non-infringement. We do not warrant that the Service will be uninterrupted, error-free, or that analysis output will be complete or accurate. Nothing in these Terms excludes liability that cannot be excluded under applicable law.

To the fullest extent permitted by law, we shall not be liable for any indirect, incidental, special, consequential or punitive damages, or for any loss of profits, revenue, data or goodwill, arising from your use of the Service. Our total aggregate liability arising out of or relating to the Service shall not exceed the greater of the amount you paid us in the 12 months preceding the claim, or GBP 50. Nothing here limits liability for death or personal injury caused by negligence, fraud, or any other liability that cannot lawfully be limited.

You agree to indemnify and hold us harmless from any claims, losses, liabilities and expenses (including reasonable legal fees) arising from your breach of these Terms, your misuse of the Service, or content you submit.

We may suspend or terminate your access to the Service if you breach these Terms or use the Service in a way that may cause harm or legal exposure. You may stop using the Service and delete your account at any time from your account settings. Sections that by their nature should survive termination (including IP, disclaimers, limitation of liability and indemnity) will continue to apply.

We may modify the Service or these Terms from time to time. Where changes are material, we will take reasonable steps to notify registered users (for example by email or on-site notice). Your continued use of the Service after changes take effect constitutes acceptance of the updated Terms.

These Terms are governed by the laws of England and Wales. The courts of England and Wales shall have exclusive jurisdiction over any dispute arising out of or relating to these Terms or the Service, save that nothing affects any mandatory consumer-protection rights you may have in your country of residence.

If any provision of these Terms is found to be unenforceable, the remaining provisions will continue in full force and effect.
